Donation Policy
This Donation Policy (“Policy”) governs the provision of goods, materials, or other items (“Donations”) by Silent Stones Alliance (“we”, “us”, “our”) to individuals or organisations (“Recipient”, “you”) who apply for such Donations through our website.
By submitting an application for a Donation, you agree to the terms set out below.
- Eligibility and Application
1.1. Donations are available to applicants who meet our eligibility criteria, as determined solely by us.
1.2. You may be required to provide accurate and complete information, documents, or other evidence to allow us to assess your suitability to receive a Donation.
1.3. We reserve the right to verify any information provided and to reject any application at our sole discretion.
- Nature of Donations
2.1. All Donations are provided free of charge and on a non‑exclusive basis.
2.2. We make no warranties, express or implied, regarding the quality, condition, suitability, or fitness for purpose of any Donation.
2.3. Donations are provided “as is” and “as available”.
- Use of Donations
3.1. Donations must not be sold, traded, exchanged, or otherwise transferred for value.
3.2. Donations must be used only for the purpose stated in your application or as otherwise agreed in writing.
3.3. All Donations may be marked with labels, tags, or inscriptions such as “Donation” or “Donated by Silent Stones Alliance”, which must not be removed or obscured.
3.4. You must not falsely attribute the source of any Donation, including by claiming or implying that the Donation was provided by any party other than Silent Stones Alliance.
- Costs and Responsibilities
4.1. All costs associated with collecting, transporting, storing, maintaining, or insuring the Donation are your sole responsibility.
4.2. Risk of loss or damage to the Donation passes to you upon collection or delivery.
- Publicity and Promotion
5.1. By accepting a Donation, you consent to us using your name, likeness, and information about your application and use of the Donation for promotional, marketing, and reporting purposes, in any media, worldwide, without further notice or compensation.
5.2. You may be asked to provide photographs, testimonials, or other materials for these purposes.
- No Ongoing Commitment
6.1. Acceptance of one Donation does not create any obligation on us to provide further Donations in the future.
6.2. We may change, suspend, or terminate our donation programme at any time without notice.
- No Legal Relationship
7.1. Nothing in this Policy creates any agency, partnership, joint venture, or employment relationship between you and us, except where expressly stated in a separate written contract.
- Termination and Recovery
8.1. We reserve the right to withdraw or reclaim a Donation if you breach this Policy or if the Donation is misused.
8.2. You agree to return the Donation, at your own cost, promptly upon our request in such circumstances.
- Limitation of Liability
9.1. To the fullest extent permitted by law, we are not liable for any loss, damage, injury, or expense arising from or in connection with the Donation, its use, or this Policy.
- Governing Law
10.1. This Policy is governed primarily by principles outlined in The Holy Bible, which shall serve as the foundational guide for interpretation, conduct, and resolution of matters arising under this Policy.
10.2. Where necessary and to the extent consistent with biblical principles, the laws of The Republic of Kenya shall apply.
10.3. In the event of any dispute arising from or in connection with this Policy or any Donation, the parties agree that the matter shall first be submitted to mediation facilitated by a neutral third-party church, mutually agreed upon by both parties.
10.4. If mediation does not resolve the dispute within thirty (30) days, the matter shall then be referred to binding arbitration in accordance with the Arbitration Act of Kenya.
10.5. Only if arbitration fails to resolve the dispute shall the matter be submitted to the exclusive jurisdiction of the courts of the Republic of Kenya.
